Your order is not accepted until Toylander Real Life Toys Limited confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Toylander Real Life Toys Limited may be unable to accommodate cancellation requests after an order is accepted. You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.
SECTION 5 - SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

However, any sales and purchases you make in our Store are made directly with Toylander Real Life Toys Limited. TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL Toylander Real Life Toys Limited, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.
SECTION 17 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Toylander Real Life Toys Limited, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.
SECTION 18 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 19 - WAIVER; ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.
SECTION 21 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the federal and state or territorial courts in the jurisdiction where Toylander Real Life Toys Limited is headquartered. You and Toylander Real Life Toys Limited consent to venue and personal jurisdiction in such courts.

All sales transactions are made under United Kingdom law.
General guide for Mainland U.K. carriage
Delivery costs are calculated at checkout for UK and other listed countries deliveries. For overseas deliveries, please contact us via contact form or email for delivery costs as each country attracts different rates. Delivery outside of UK excludes all import charges, customs charges, tariffs and tax duties payable by customer before final delivery. Toylander Ltd is not responsible for any delivery delays due to unforeseen circumstances out of our control.
Delivery to Europe and Worldwide
All import duties, tariffs, customs charges or taxes are for customer account, including any additional charges/tariffs, storage or documentation charges. Delivery INCO terms are DAP. Toylander RLT Ltd is not liable or responsible for any delivery delays or related costs due to any unforeseen circumstances; for example, but not limited to; courier delays, customs delays, pandemics or political disruption, weather, failure of customer to contact freight forwarder/agent or customs authorities. Overseas customers will be given tracking numbers to track their order shipment.
Delivery of the goods shall be made to the customers address. The customer shall make all arrangements necessary to take delivery of the goods on the day notified by Toylander or the courier for delivery. Toylander undertakes to use its reasonable endeavours to despatch the goods on an agreed delivery date, but does not guarantee to do so.
Delivery charges vary according to the type of goods ordered.
Toylander shall not be liable to the customer for any loss or damage whether arising directly or indirectly from the late delivery or short delivery of the goods. If the customer fails to take delivery of the goods on the agreed delivery date or, if no specific delivery date has been agreed, when the goods are ready for despatch, Toylander shall be entitled to store and insure the goods and to charge the customer the reasonable costs of so doing.
Loss or damage of goods
Goods are forwarded at the customer's risk. In the event of a claim being made against the carrier or Post Office for loss or damage, we retain copies of posting/dispatch certificates for all goods dispatched. Goods should be examined immediately upon receipt, with any loss or damage reported immediately and in writing within three working days to both the carrier and ourselves. Only sign the receipt from the carrier if goods are in new condition. Sign unchecked if necessary. Failure to do this may invalidate your claim. DO NOT SIGN FOR DAMAGED GOODS. TAKE PHOTOGRAPHS OF ANY DAMAGED PARTS FOUND AFTER OPENING AND SEND TO US WITH DESCRIPTION, DATE AND TIME.
Liability and Insurance
At no time should the Toylander vehicle(s) be entrusted to the charge of a child without strict parental/adult supervision and control.
By purchasing the Toylander vehicle(s)/kit(s) the purchaser agrees to supervise any child using the vehicle and accepts all responsibilities and liabilities during its use. Toylander Real Life Toys Ltd accept no responsibility or liability for any claims against loss, damage or injury of any kind during the use of this vehicle by customer or any person(s). Toylander is not responsible or liable for any customers loss of profit or revenue whilst using the products or Toylander vehicles.
Adequate insurance cover against loss, damage and 3rd party liability incurred whilst using the vehicle is the sole responsibility of the purchaser.
Payment
All goods are supplied on a payment with order basis. Full payment must be received by Toylander RLT before delivery. Payment may be made online, by BACS made out in £ Sterling/GBP ALL COSTS INCLUDED please. Additional £12 ON OVERSEAS PAYMENTS by BACS will be added to invoice. We also accept payment by debit or credit card, PayPal (additional charges may apply). If payment is made by card, please ensure all details are included and correctly stated – DO NOT SEND US PAYMENT CARD DETAILS BY EMAIL. Goods may also be ordered and payment made by telephone. You will need to quote card number, expiry date (issue number for switch), security code plus cardholder’s full name, address and postcode where card is registered. Delivery only to registered card holder’s address. Risk and Ownership - Legal and equitable title for all goods shall remain with us until all monies due have been received and we reserve the right to repossess the goods until such time as payment in full has been received. Please do not email bank or credit card details, we do not accept any liability for any losses due to this information being sent by email.
Once paid in full this forms a legally binding contract between Toylander RLT and purchaser.
It is the responsibility of the customer and or Purchaser to confirm and verify bank details to before they make any payment for goods – Toylander Real Life Toys Ltd accept no responsibility or liability for any claims against loss, due to payment to incorrect bank account, or payment to a scam email.
Cancellation rights
No refunds will be given to cancelled orders for any handmade ready-to drive vehicles or trailers.
For all kits and parts you have the right to cancel under Under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 SI 2013/3134 you have the legal right to cancel your order up to 14 calendar days after the day on which you receive your goods (with the exception of goods mentioned below). You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.
Should you wish to cancel your order, you can use the cancellation form provided at the end of these terms and conditions, or alternatively you can notify us by any other clear statement.
You cannot cancel your contract if the goods you have ordered are made to your specifications or are clearly personalised.
If you have received the goods before you cancel your contract then you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery, you should not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.
Once you have notified us that you are cancelling your contract, and we have agreed that goods can be returned, once received, we will refund any sum debited by us from your credit or debit card within 14 calendar days.
We may make a deduction from your refund for any loss in the value of the goods supplied if the loss is the result of unnecessary handling by you (for example using the goods prior to cancellation).
Cancellation by us
We reserve the right not to process your order if:
We have insufficient stock to deliver the goods you have ordered;
We do not deliver to your area; or
One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do not process your order for the above reasons, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit/debit card as soon as possible, but in any event within 14 days.

We are under a legal duty to supply goods that are in conformity with this contract and in accordance with the Consumer Rights Act 2015 (the Act).
If you wish to exercise your legal rights to reject goods which do not conform with the Act you must either return them in person to where you bought them, post them back to us, or (if they are not suitable for posting) or allow us to collect them from you.
We will pay the cost of postage or collection.
Dispatch
Every effort is made to ensure goods are dispatched without delay, however, at certain times of the year, delays inevitably occur.
Force Majeure
If either party to this Agreement is prevented or delayed in the performance of any of its respective obligations under this Agreement by “force majeure”, then such party shall be excused the performance for so long as such cause of prevention or delay shall continue. For the purpose of this Agreement ‘force majeure’ shall be deemed to be any cause affecting the performance of this Agreement arising from or attributable to acts, events, omissions or accidents beyond the reasonable control of such party and inter alia including, but not limited to the following: Strikes, lockouts or other industrial action; Terrorism, civil commotion, riot, invasion, war threat or preparation for war; Fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, bad weather or other natural physical disaster; Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; and Political interference with the normal operations.
Title and Risk
Risk shall pass on delivery of the products to the customer/purchaser’s address. Title of the goods will remain with Toylander until all invoices are paid in full.
All rights, including copyright, in this website are owned by or licensed to Toylander Real Life Toys Ltd. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.
Accuracy of content
We have taken care in the preparation of the content of our website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been described accurately. However, orders will only be processed if there are no material errors in the description of the goods or their prices as advertised on this website. Any weights, dimensions and capacities given about the goods are approximate only.
Damage to your computer
We try to ensure that our website is free from viruses or defects. However, we cannot guarantee that your use of our website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using our website.
Availability
All orders are subject to acceptance and availability. If the goods you have ordered are not available from stock, we will contact you by e-mail or phone (if you have given us details). You will have the option either to wait until the item is available from stock or to cancel your order.
Prices and VAT
Toylander RLT Ltd is registered for VAT. Online prices include VAT and are correct at the time of going to press but we reserve the right to amend the price shown at any time. Further we reserve the right to alter any specification, withdraw or substitute items without prior notice. VAT is deducted from prices for all countries outside of UK and including Channel Islands.
Compliance with Rules and Laws
All Toylander products are made to adhere to safety rules and regulations of the UK and the EU. For all overseas customers and orders, it is the Purchasers responsibility to check that products are suitable for the territory where they will be used.
Guarantees
All components supplied are guaranteed for a period of twelve months, (excluding batteries whether part of a kit, fitted to a ready-made Toylander vehicle or purchased separately), from the date of dispatch, on a return to TRLT Ltd basis. This guarantee does not cover damage caused by accident, neglect, wear and tear or misuse. All goods, (excluding batteries and ordered products) are covered by a full refund policy (see Cancellation Rights above) as long as the goods are in a saleable condition and unused. All kit parts and packs must be returned unused and with all components included. Returned parts will be checked for quality before any refund is given.
Copyright and Intellectual Property
The purchase of Toylander manuals, kits and parts entitles the purchaser to build one Toylander only. Parts, designs and ready made Toylander vehicles are not to be copied or reproduced to sell and trade. Designs of any part of the manuals, kits, ready made vehicles and components are not to be shared, passed onto third parties or made into electronic format for CNC, CAD or any other such electronic format. Any infringements will be followed up with legal action against any persons or companies who copy Toylander RLT designs or products.
Notices
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at [see below] and all notices from us to you will be displayed on our website from time to time.
Changes to legal notices
We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.
Law, jurisdiction and language
This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
